Nazri chides PAS VP over shariah bill

Former law minister says amendments sought by Bill can't be implemented without revamping the various state religious enactments.

The amendment to Section 355, Shariah Courts (Criminal Jurisdiction) Act 1965, will be hard to implement nationwide as the religious enactment needs to be passed in their respective state assemblies first, said Tourism and Cultural Minister Nazri Aziz.

Responding to PAS Vice-President Mohd Amar Nik Abdullah, Nazri said the private member’s Bill, seeking the amendment to the Act, tabled by PAS President Abdul Hadi Awang in Parliament recently, first needs to be passed.

Then the religious enactments in each state needs to be revamped as well to comply with the Bill.

He said religion is a state issue and the state assembly in Kelantan must pass the amendment to the enactment – Kelantan Shariah Criminal Code.

“You also cannot simply use the Kelantan enactment in other states.

“Kelantan is not Malaysia, Kelantan is not Malacca or Perak. Kelantan is Kelantan.

“So Act 355 is a federal law, but when you want to implement, the state assemblies must amend their own religious enactments first,” he told reporters at an event in Sungai Nibong today.

Nazri, the former de facto law minister, also took jibes at Mohd Amar, saying the PAS leader should not “teach him about law”.

Mohd Amar was reported today by Malay Mail Online as saying that the true intention of PAS’ shariah bill is not simply to enhance the punitive powers of the east coast state’s shariah courts but to ensure the same for all states nationwide.

He reportedly said the Bill tabled seeks to elevate and streamline the powers of the country’s entire shariah justice system.

Nazri, who is also the Padang Renggas MP, said there was no fixed template for hudud anywhere in the world and PAS can’t claim its version as the true one.

“I want to ask, in this world, is there a template that says that you need to comply with these regulations to be an Islamic country (then)? Please show me.

“If he (Mohd Amar) says that (there is a fixed template), that means even in Kelantan they are not Islamic.

“If that is the case, even his ancestors did not practise the right Islamic practices.”
