
He said this after the Federal Court on Friday struck down 16 provisions of the Kelantan Syariah Criminal Code (I) Enactment 2019 on grounds of unconstitutionality.
“The state government will take appropriate action if any party wishes to challenge the state’s shariah criminal code enactment,” he told Utusan Malaysia.
The PAS vice-president also said Friday’s ruling may impact the shariah legal system in the country.
The apex court had in an 8-1 majority decision struck down 16 criminal offences contained in Kelantan’s Syariah Criminal Code (I) Enactment 2019, holding that they violated the Federal Constitution.
Delivering the majority decision, Chief Justice Tengku Maimun Tuan Mat said the Kelantan state assembly did not have jurisdiction to legislate on those matters.
In 2022, lawyer Nik Elin Zurina Nik Abdul Rashid and her daughter, Tengku Yasmin Nastasha Tengku Abdul Rahman, filed a constitutional challenge over the Kelantan assembly’s authority to pass 18 provisions in the Kelantan Syariah Criminal Code (1) Enactment 2019.
They later withdrew their objection to two of the provisions.
