May 17 court decision on Tony Pua travel ban

A letter from IGP stating Pua was under criminal investigation not produced in court, says lawyer Gobind Singh Deo.

Doubts have been thrown over the independence of the decision to deny DAP lawmaker Tony Pua from leaving the country, the High Court was told today.

Pua’s lawyer Gobind Singh Deo said the letter dated July 15 from the Inspector-General of Police stated that Pua was under a criminal investigation.

He said following the letter, the immigration director-general gave orders to the Immigration Security and Passport division director on July 17 to deny Pua from leaving the country on July 22.

“The question is, in our submission, it’s because of this letter that he was denied permission to leave the country.

“They have not produced the letter for the judicial review.

“The decision maker needs to show that he had complied with all the procedures of requirements,” Gobind told reporters after Pua’s judicial review application to quash the travel ban today.

He said the then Immigration DG must produce the letter from the IGP to give context to the decision made.

“If you don’t produce that, there’s a gap,” he said.

Pua was prevented from leaving the country at KLIA2 on July 22 last year.

The DAP national publicity secretary was supposed to go to Yogyakarta that day using his passport, which was valid until April 23, 2020.

He had claimed that the decision was ineffective under the law as it was in contradiction with his legitimate right to travel abroad using his valid passport.

The judicial review was heard by High Court (Appellate and Special Powers) judge Justice Hanipah Farikullah.

The government was represented by Senior Federal Counsel Shamsul Bolhassan.

A decision on the case will be made on May 17 at the High Court.
