Baling court acquits cop of keeping stolen fridge, purifier

The judge says the prosecution failed to prove a prima facie case against the police corporal, who had been charged with retaining stolen items from a 2022 house theft.

A police corporal accused of keeping a stolen fridge and water purifier in 2022 has been acquitted by the magistrates’ court here which ruled that the prosecution failed to prove its case.

Iskandar Zulfekhar Musa, 36, attached to the Kupang police station, walked free after magistrate Najwa Che Mat found insufficient evidence against him after reviewing testimonies from prosecution witnesses and written submissions from both sides.

“Therefore, the accused is acquitted and discharged without being called to enter his defence,” she said in her ruling.

Iskandar had been charged with knowingly keeping a Sharp-brand refrigerator and a Cuckoo-brand water purifier which were stolen from a house in Kampung Pokok Setol in Baling on June 9, 2022.

He claimed trial on May 18, 2023 and was released on bail of RM8,000.

If convicted under Section 411 of the Penal Code of dishonestly retaining stolen property, he could have faced up to five years in prison, a fine, or both.

The prosecution had called 10 witnesses to support the charges.

Deputy public prosecutor Amirul Halimi Mat Salleh prosecuted while S Sagthiyaraj represented Iskandar.
