
The court ruled that Zulhaimi Moharani, 33, and Nadia Zaidi, 28, had no case to answer and freed them of charges involving the possession of methamphetamine, cannabis and MDMA.
The drugs were discovered in a condominium unit at Balakong in July 2020.
Justice Roszianayati Ahmad said the prosecution did not establish a prima facie case and the defence had raised serious doubts about the evidence tendered.
She said key details about the connection between the couple and the drugs were of concern.
The court found that the accused were not the owners or tenants of the unit where the drugs were found, had no exclusive access to it, and were not arrested at or near the place where the drugs were discovered.
The couple were first detained on July 21, 2020, after narcotics officers from Sentul arrested them outside the Sungai Besi police station. They were at the station over a motor vehicle accident case.
The raiding officers from Sentul claimed they had found a key and access card to the condominium in the car driven by Nadia.
Police later used the key card to enter the condominium, where a suitcase containing the drugs was found in the kitchen.
The prosecution called 16 witnesses, including the condominium owner and staff responsible for managing the property’s CCTV system.
Roszianayati highlighted several gaps in the evidence, including the presence of DNA from other individuals in the unit and contradictions in the testimonies of prosecution witnesses.
The court also pointed to the prosecution’s failure to call the tenant of the condo unit to testify.
Deputy public prosecutor Maizatul Munirah prosecuted, while Geethan Ram Vincent and Eu Kah Mun represented the accused.
