
The lawyer acting for Smit’s family, SN Nair, said the police issued the notice regarding Alex Johnson and Luna Almaz on Oct 9.
An Interpol Blue Notice is a notice to locate, identify or obtain information on a person of interest in a criminal investigation.
Smit, then 18, was found dead on the sixth floor of a condominium block in Kuala Lumpur on Dec 7, 2017, purportedly after falling from a 20th floor unit occupied by Johnson and Almaz.
An inquest held in 2018 determined Smit’s death to be a misadventure.
However, in revision proceedings before the High Court, Justice Collin Lawrence Sequerah ruled that Smit’s death had been caused by persons known or unknown.
Smit’s family have since filed a lawsuit against the police and government alleging breaches of statutory duties and negligence in their investigations into Smit’s death.
The case was set to go to trial in the Kuala Lumpur High Court today after federal counsel Anis Najwa Nazari said on Sept 30 that proposals made by Smit’s family during mediation were not acceptable to the police and the government.
However, Nair today said that settlement efforts were still under way, with the court today deciding that the trial originally set for today and Wednesday to be vacated.
“The parties have considered a potential settlement, the details of which cannot be disclosed at this time,” he said in a statement.
“The court has scheduled a follow-up on Oct 21 for the parties to provide an update on the settlement. If no resolution is reached, the trial will proceed on that date.”
Johnson and Almaz left the country after police interviewed them. It was previously reported that the couple had moved to Miami, in the United States.
In 2019, the couple said they intended to take legal action against Smit’s family for accusing them of causing her death, stating that there was no proof they were implicated in the matter.
