Court allows creditor’s petition to wind up MYAirline

The Shah Alam High Court has allowed a winding-up petition by a creditor of now-defunct airline operator MYAirline Sdn Bhd.

Corporate Information Travel Sdn Bhd (CIT) obtained a judgment at the Kuala Lumpur sessions court for about RM240,000 on Feb 26.

Judicial Commissioner Raja Rozela Raja Toran also allowed the petitioner to appoint Tee Guan Pian as liquidator, and costs of RM5,000 to be paid out of the assets of MYAirline.

Lawyer Muralee Menon from M Menon & Partners said the petition was unopposed.

The debt arose from an agreement entered on Feb 15 last year which saw CIT appointed as a registered travel agent of the carrier.

Pursuant to the agreement, CIT deposited a sum of RM250,000 with MYAirline. Under the terms of the agreement, MYAirline was entitled to deduct the price of tickets issued by CIT from the sum deposited.

As of Oct 10 last year, CIT had a credit balance of RM241,901.60 in the account which it sought as a refund. It took legal action and secured a judgment for the sum due after MYAirline failed to refund the monies.

On June 27, FMT reported that 213 investors had filed a civil suit at the High Court in Shah Alam against MYAirline co-founder Goh Hwan Hua over an allegedly fraudulent investment scheme.

The suit also named Goh’s wife, Neow Ean Lee, a company in which Neow is a director, and 17 entities linked to Goh, including MYAirline, as defendants.

According to the statement of claim, the plaintiffs are seeking a repayment of monies that they deposited with several corporate entities under the I-Serve group of companies over which Goh had effective control.

They are also seeking damages for fraud, negligence, conspiracy and innocent misrepresentation, as well as exemplary and aggravated damages.

On Oct 12 last year, MYAirline announced that it had suspended operations because of severe financial challenges.

Five days later, Goh and two family members were detained to facilitate an investigation under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.
