
Justice GSP Bhupindar Singh said he found no special circumstance that warranted the accused being granted bail.
He said based on the prosecution’s submissions, there were reasonable grounds to believe that an offence under Section 302 of the Penal Code had been committed, Berita Harian reported.
After proceedings, deputy public prosecutor Afzainizam Abdul Aziz said the defence had argued that the safety of the accused was under threat as he would have to mix with other detainees in jail. The defence had also claimed that the safety of Nazri’s family was in question as the case had gone viral, he said.
However, Afzainizam told reporters that police found no threats to the family of the accused.
He also said the question of Nazri’s safety in jail was not mentioned in the defence’s affidavit. The accused had only said that being in prison made it hard for him to meet his lawyers.
“The prisons department had never obstructed him from meeting his lawyers in prison,” Afzainizam said.
Nazri, a deputy superintendent of police, was represented by lawyers Jacky Loi, Lim Chi Chau, Lim Jin Wen, Cindy Wong and M Kuhan.
On May 14, Nazri pleaded not guilty to the murder charge, following which the trial was set for 30 days, from Nov 4 to Jan 17 next year.
He is accused of causing the death of Zaharif Affendi Zamrie near SMK Jati, between 12.05pm and 12.40pm, on Dec 15 last year.
He was charged under Section 302 of the Penal Code, which carries the death penalty or 30 to 40 years’ imprisonment, and a minimum of 12 strokes of the cane upon conviction.
