Anwar gets discovery from ex-aide in sexual assault suit

Court says the documents requested by Anwar Ibrahim from Yusoff Rawther are necessary for the determination of the case.

The High Court here has allowed Anwar Ibrahim’s bid to obtain WhatsApp conversations and a statutory declaration from his former research assistant Yusoff Rawther in an ongoing lawsuit between them.

Yusoff had in 2021 brought the suit against Anwar, claiming that the latter had sexually assaulted him on Oct 2, 2018. He later affirmed a statutory declaration setting out details of the alleged incident.

Delivering his decision, judicial commissioner Mohamad Johan Lee ruled that Anwar’s discovery application had merits.

“All documents required therein are related and necessary for the determination of the case,” Johan added.

The court also ordered Yusoff to pay RM1,000 in costs to Anwar. It also fixed the suit for case management on April 13.

Anwar, who is the sitting prime minister, had applied for Yusoff to hand over copies of their WhatsApp conversations between Sept 2, 2018, and June 5, 2019.

He also asked Yusoff to produce the statutory declaration, affirmed on Nov 19, 2019, and a copy of a police report lodged against Anwar’s then political secretary Farhash Wafa Salvador Rizal Mubarak.

Yusoff alleged Farhash assaulted him in May that year, which led him to lodge the police report.

In his statement of claim, Yusoff alleged that Anwar sexually assaulted and molested him at Anwar’s home in Segambut.

He also claimed that he was accused of conspiring to bring down and damage Anwar’s political career, and this had affected his mental health.

Yusoff is seeking special, general, aggravated and exemplary damages, together with interest and legal costs.
