
Shamsubahrin, 56, was charged in the Ayer Keroh sessions court in Melaka with cheating under Section 420 of the Penal Code, which provides for a jail term of up to 10 years, whipping and a fine, if convicted.
He is accused of cheating Rauf over the sale of a 2019 Toyota Alphard, for which the former Melaka state assembly speaker paid him RM95,000 in cash.
According to Kosmo, the cash was for the purchase of the vehicle, which was worth RM180,000, with the registration number VVP 7.
On the second charge, Shamsubahrin is accused of using a “Datuk” title for personal gain without written permission from the chief minister.
This charge was framed under Section 3(1)(a) of the Emblems and Names (Prevention of Improper Use) Enactment 1981, which provides for a maximum fine of RM500,000 or up to five years in jail, or both, if found guilty.
The offences were allegedly committed at the office of the Melaka state assembly speaker at Seri Negeri on Dec 7, 2021.
Shamsubahrin was allowed bail of RM30,000 for both charges but was ordered to surrender his passport and report himself at a police station every month.
The court set Feb 7 for case mention and submission of documents.
Deputy public prosecutor Aliff Asraf Anuar Sharuddin prosecuted, while Shamsubahrin was represented by Loh Chon Mee.
