Publisher’s 10-year legal battle with Selangor govt, Jais ends

Publisher Ezra Zaid’s legal battle against the Selangor government and the Selangor Islamic Religious Department (Jais) over wrongful prosecution has come to an end after 10 years.

High Court judge Ahmad Kamal Md Shahid recorded a settlement between Ezra and the state government over a judicial review to challenge Jais’ decision to charge him in the shariah court for publishing and selling a book which they said contravened the teachings of the Quran and hadith.

However, the terms of settlement and amount in damages were not disclosed to the public.

Ezra was charged in the shariah court with publishing Canadian author Irshad Manji’s book, “Allah, Liberty and Love” and its translated version in Bahasa Melayu. The book was banned in 2012.

Ezra subsequently filed for a judicial review in the civil court.

In 2019, the Court of Appeal quashed the charge and ordered the High Court to assess damages in favour of Ezra.

The state government sought to appeal before the Federal Court but its bid to appeal was turned down in September 2020.

Three months later, on Dec 17, the shariah subordinate court in Shah Alam freed Ezra of his charge under Section 16 of the Shariah Criminal Enactment.

However, shariah judge Shukran Yusof allowed Jais to forfeit the 180 copies of the books seized from Ezra during their raid at his office on May 29, 2012.
