Ask AG to prod police in sex assault case, says lawyer

A Srimurugan says a complainant can ask the Public Prosecutor to direct police to provide an update about her report.

Complainants have the right to write to the Public Prosecutor if there is no action by police on their report, a lawyer said today following complaints by an alleged sex assault victim.

A former legal practitioner, Samantha Chong, whose modesty was allegedly outraged during a party had demanded answers from the Inspector-General of Police about the lack of action on her complaint.

Lawyer A Srimurugan said complainants had the right under the Criminal Procedure Code to ask the officer in charge of the police station for a status report on the investigation.

“If the officer fails to furnish the information, the complainant may then make a report to the attorney-general, who is the public prosecutor, for failure to give the report,” he said.

The public prosecutor then may direct the officer to update the complainant of their probe, he said.

On Friday, Samantha Chong questioned why it was taking so long to get an update on a police report of a sexual assault she lodged six months ago.

In a series of tweets to Inspector-General of Police Abdul Hamid Bador and AG Tommy Thomas, she said the investigating officers had chosen to ignore her most of the time.

Chong, 34, had said that the assailant, said to be drunk, had groped her at least twice during the annual dinner of criminal lawyers in June.

Another lawyer, R Kengadharan, said Chong could file a civil suit against her alleged assailant, but would only obtain monetary compensation if she proved her claim.

Kengadharan said there was only one reported case of a female employee who obtained RM120,000 in damages against her superior for sexual harassment at their workplace.
