Lawyer files motions to censure 6 seniors for alleged misconduct

PETALING JAYA: A lawyer, who came under the spotlight for urging a ban on alcohol consumption at Bar events nationwide, has filed motions against six senior lawyers for their alleged non-compliance with the Legal Profession Act 1976 and rulings.

Mohd Amir Sharil Bahari Md Noor wants them censured at the Bar annual general meeting (AGM) on Saturday and the in-coming Bar Council to refer them to the Advocates and Solicitors Disciplinary Board.

The lawyers cited include a former Malaysian Bar president, incumbent Bar Council members and a state Bar Committee chairman.

FMT has sighted the motions but is unable to reveal the contents due to legal implications. The Bar AGM is also a closed door affair.

Better known among friends as Amir Bahari, the lawyer is again causing a stir ahead of this year’s AGM for filing seven of the 15 motions submitted to Bar secretary Roger Chan Weng Keng, one of which called for a ban on alcohol consumption at Bar functions.

The lawyer also gained notice last year when he suggested to “Islamise” the Malaysian Bar.

If his motion is approved, Amir Bahari wants the alcohol ban extended to events organised by state Bar Committees as well.

The motion filed last week is endorsed by at least 25 lawyers.

It is supported with Quranic verses and sayings of Prophet Muhammad that alcohol consumption is prohibited among followers of the Islamic faith.

Last year Amir Bahari first filed a motion to stop serving alcohol at Kuala Lumpur Bar events, and then proceeded to argue his case at the Bar AGM.

The motion at the AGM was rejected with 588 votes against, nine in favour and 16 abstentions.

Amir Bahari, in an interview with FMT then, said Bar members came from diverse, multi-ethnic and multi-religious backgrounds, and pointed out that alcohol consumption was prohibited by almost all religions.

The lawyer said the budget for organising an event increased by up to 40% when beer and liquor were served.

Amir Bahari had said removing the practice of serving alcohol would make the Bar shariah-compliant.

He also claimed that the serving of alcohol made Muslim lawyers present uncomfortable.

Meanwhile, the Bar Council through its chairman George Varughese has also filed three motions to be debated at the AGM.

Two concern the discovery of “death camps” in Perlis and the Continuing Professional Development Scheme.

The third calls for the total abolition of the death penalty and the immediate enforcement of the Dangerous Drugs (Amendment) Act 2017 that gives judges the discretion to impose a jail term for trafficking instead of the mandatory death sentence.
