Santamil’s lawsuit against Deepak Jaikishan thrown out

The Federal Court said the notice of appeal by the widow against the High Court order striking out her suit was defective.

The Federal Court has struck out the lawsuit by A. Santamil Selvi, the widow of P. Balasubramaniam or PI Bala, against businessman Deepak Jaikishan over his purported role with seven others.

They allegedly sent her family of five into exile between 2008 and 2013.

Chief Judge of Malaya Justice Zulkefli Ahmad Makinuddin allowed Deepak’s appeal, on Monday, against the appeals court reinstating the lawsuit in the High Court last year.

“We have a reached a unanimous decision. We answer question two in the negative,” he said. “The notice of appeal by Santamil, against the High Court order striking out her suit, was defective.”

“We affirm the decision made by the High Court”.

He was referring to the question posed, whether a single notice of appeal in respect of eight separate and distinct interlocutory applications, was in compliance with the Rules of the Court of Appeal 1995.

Other judges in the panel included Justices Zainun Ali, Abu Samah Nordin, Ramly Ali and Balia Yusof Wahi.

No order was made to cost.

Deepak’s lawyer Shafee Abdullah said that with the Federal Court’s decision, the lawsuit has now ended against the remaining party, his client.

Last year, the Federal Court dismissed Santamil’s application to amend her notice of appeal to reinstate the lawsuit against Prime Minister Najib Abdul Razak, his wife Rosmah Mansor and five others for sending PI Bala and family to exile.

Santamil filed a lawsuit in 2014 on the said roles of the individuals after he retracted his statutory declaration on Najib’s involvement in Mongolian Altantuya Shaariibuu’s death. The suit explained why PI Bala was forced to retract his statutory declaration.
