Deepak appeals to have suit by PI Bala’s widow struck out

2014 suit was filed by private investigator P Balasubramaniam’s widow for the losses the family incurred during the family's five-year exile.

PETALING JAYA: Carpet dealer Deepak Jaikishan has filed an appeal to prevent a suit by the widow of a key witness in the Altantuya Shaariibuu murder trial from being heard in the High Court.

According to The Malaysian Insider, the suit was filed in 2014 by private investigator P Balasubramaniam’s wife, A Santamil Selvi, for the losses the family incurred during their five-year exile.

Santamil’s lawyer, Americk Sidhu said Deepak had filed the appeal in the Federal Court to quash a Court of Appeal’s ruling which stipulated that a trial was to be held to determine the legitimacy of the widow’s claim.

Lawyer Muhammad Shafee Abdullah would now be representing Deepak, added Americk.

“Shafee’s legal firm sent me a copy of the application for leave to appeal before the Federal Court,” Americk was quoted by the news portal as saying.

Case management has been fixed for February 5, but Americk said he would write to have the matter adjourned as he would be out of the country then.

On December 18 last year, the Court of Appeal ruled that Santamil’s RM2 million suit could be filed in her personal capacity, as “allegations of conspiracy had merit” and is subjected to be tried in the High Court.

Santamil is suing Deepak and seven others, including Prime Minister Najib Razak and his wife Rosmah Mansor, for allegedly sending her family into exile to India for five years from 2008.
