
Fadwan Muaain, 42, was jailed for nine months for wrongful confinement, and six months for hurting the victim, Berita Harian reported.
Magistrate Wan Noora Nisa Ngadirin ordered the sentences to run consecutively from today.
According to the first charge, Fadwan wrongfully confined the teenager by tying his hands and legs at the apartment between 8.05am and 11.50am on May 11.
The charge was framed under Section 342 of the Penal Code, which provides for up to a year’s imprisonment, a fine of up to RM2,000, or both.
Under the second charge, Fadwan was accused of intentionally causing hurt to the victim at the same location and time under Section 323 of the Penal Code, which carries the same punishment.
Fadwan, who is divorced and has one child, told the court he confined the victim to obtain information on how to break into the teenager’s house and steal gold items.
Deputy public prosecutor Nur Amirah Zahari appeared for the prosecution, while Fadwan was represented by National Legal Aid Foundation lawyer Adli Hakim Azami.
In separate proceedings at the sessions court, Fadwan also pleaded guilty to sodomising the same victim at the same location and date.
The charge was framed under Section 14(d) of the Sexual Offences Against Children Act 2017, which provides for up to 20 years’ imprisonment and whipping, upon conviction.
The sessions court judge fixed June 8 for the handover of Fadwan’s criminal record and sentencing.
Deputy public prosecutor KS Rinisha Priyya appeared for the prosecution while Fadwan was unrepresented.
Fadwan was previously convicted of the rape, robbery and confinement of a woman in 2008.
