Court rejects firm’s bid to challenge pharmaceutical tracking tender

The Kuala Lumpur High Court ruled that Techno Secure Print Sdn Bhd’s application was not suitable for leave.

The High Court in Kuala Lumpur has dismissed an application by Techno Secure Print Sdn Bhd to begin judicial review proceedings over a health ministry tender for a pharmaceutical tracking and tracing system.

Justice Alice Loke ruled that the application was not suitable for leave, saying the court must still assess the relief sought even though the threshold for obtaining leave was low, Bernama reported.

“The government must justify not only the tender process but also the awarding of the tender.

“This application is not suitable for granting leave in this case. Therefore, the application is dismissed,” she said, making no orders as to costs.

Techno Secure Print filed the application on Dec 29, 2025, naming the health ministry, its minister and the federal government as respondents.

The company sought to contest the ministry’s decision to award an open tender to Netsmart Sdn Bhd on Sept 30 last year for the supply of security labels and management of the Pharmaceutical Track & Trace System (PTTS).

It also wanted the court to grant a mandamus order compelling the ministry to carry out a fresh open tender, described as a third-round retendering with additional scope, for the security labels supply and PTTS management contract.

The company also asked the court to quash the tender award to Netsmart.

In the alternative, Techno Secure Print sought special damages of RM79,114.84, general damages to be assessed, and exemplary damages.

Federal counsel Kimberly Ye appeared for the Attorney-General’s Chambers, while Techno Secure Print was represented by Azhar Azizan Harun, Kenny Chan and Lim Poh Leong.
