Duo at 2022 Merdeka eve party freed of drug trafficking charges

Judge says the prosecution failed to prove that businessman N Suresh and barber R Nagarajan had exclusive custody and control of meth and heroin.

KUALA LUMPUR:
Two men walked free after the High Court here today acquitted them of trafficking in drugs at a house where they had gathered for a Merdeka eve celebration over three years ago.

Justice Noor Ruwena Nurdin said the prosecution failed to prove that businessman N Suresh, 37, and barber R Nagarajan, 49, had exclusive custody and control of the drugs.

Suresh and Nagarajan were accused of possessing 315.58g of methamphetamine and 22.5g of heroin at the house off Jalan Udang Harimau in Segambut at about 2.30am on Aug 31, 2022.

A Krishnan, 54, who rented the house, was jointly charged with the two, but died in custody before the trial began.

A person is deemed to be a trafficker under the Dangerous Drugs Act 1952 if found to be in possession of more than 50g of methamphetamine and 15g of heroin.

Defence counsel S Revin Kumar, who appeared for the duo, submitted that his clients were not occupants of the house and were merely guests on the night of the police raid.

“The two had gone into the house to use the washroom when a police team raided the house,” he said.

During the prosecution’s case, it was revealed that the house was used as a front to process drugs.

The prosecution, conducted by deputy public prosecutor Faridah Nurdinie, had called the chemist, the raiding officer, and the investigating officer as witnesses.
