Facebook user admits Fahmi did not give political speech in mosque, regrets post

Fauzan Madzlan and communications minister Fahmi Fadzil recorded a consent judgment before a High Court judge today.

Facebook user Fauzan Madzlan has admitted that communications minister Fahmi Fadzil did not engage in political campaigning at a mosque in Selangor during the state election three years ago, as part of a settlement reached between the parties.

The settlement was recorded as a consent judgment before High Court judge Raja Ahmad Mohzanuddin Shah Raja Mohzan today.

Fahmi’s lawyer, Asheeq Ali Sethi Alivi, said Fauzan acknowledged that Fahmi’s speech at a mosque in Rawang, Selangor, on July 30, 2023, during the state election was neither a political campaign nor politically motivated.

“The defendant further admitted that Fahmi had merely responded to a question raised at the mosque regarding the controversy surrounding the band The 1975, which had become an issue during the Selangor state election in 2023.

“The defendant also expressed regret over a Facebook post dated July 31, 2023, commenting on the matter, which formed the subject matter of the present suit,” he said.

Earlier, another of Fahmi’s counsel, Fahri Azzat, informed the court the parties had agreed to resolve the matter amicably.

Under the terms of the consent judgment, no party may publish the statement in full. However, they may comment on the settlement, provided such remarks remain consistent with the substance of the settlement.

They also agreed not to repeat or republish any defamatory statements that formed the subject matter of the suit.

The parties further agreed that they had no further claims against each other arising from the dispute and that the suit be withdrawn by the plaintiff with no order as to costs.

The case stemmed from allegations in 2023 that Fahmi had engaged in political campaigning in a mosque. He denied the claims, maintaining that they were defamatory and had harmed his reputation.

Fauzan’s lawyer, Zamri Ibrahim, also told the media that both parties agreed Fahmi did not deliver a political speech at the time.

Fauzan contested the Kuang state seat in the 2018 general election under a PAS ticket but lost to Pakatan Harapan candidate Sallehudin Amiruddin in a four-cornered fight.

A settlement was also reached with another defendant, political influencer Wan Azri Wan Deris, also known as Papagomo, over the same allegations.

Asheeq told the media Wan Azri had acknowledged that Fahmi’s speech at the mosque was neither a political campaign nor political in nature.

He said the acknowledgment came after Wan Azri considered further explanations and statements from the authorities, as reported by the media.

“Any issues that arose were the result of a misunderstanding that should not have occurred in the first place, and the parties have agreed not to issue any statements other than those set out in this agreed statement,” he said.

However, the suit against the third defendant, preacher Dusuki Rani, will proceed as no settlement has been reached between the parties.

Fahmi is scheduled to testify tomorrow.

Lawyers Logen Iskandar Abdullah and Norfazilah Jaafar represented Wan Azri, while Jamil Yaacob and Kamaruzaman Jusoh represented Dusuki.

Iqbal Harith Leang also appeared for Fahmi.
