The driver, who was arrested and remanded until Thursday, was found to have been under the influence of alcohol and drugs at the time of the incident.

When contacted, the case’s investigating officer said the driver would be charged at 8.30am. However, he was not certain under which legal provision the driver would be charged.

The driver was investigated under Section 44(1) of the Road Transport Act 1987, which makes it an offence to drive under the influence of alcohol or drugs and cause death or injury.

Those convicted may face 10 to 15 years in prison and between RM50,000 and RM100,000 fine.

Amirul, 33, was killed after being rammed by a car.

A dashcam video clip posted online showed a car overtaking in the opposite lane crashing into Amirul’s motorcycle, sending him flying into the air and landing on top of another vehicle.

He was pronounced dead at the scene.

The case has drawn national attention, with the transport ministry proposing amendments to the Road Transport Act 1987 to compel offenders to pay compensation to victims’ families.
