The call was made during the division’s convention today, chaired by Donald Peter Mojuntin, which passed a resolution supporting the Kota Kinabalu High Court’s judgment in the judicial review filed by the Sabah Law Society (SLS) concerning the 40% revenue entitlement, Borneo Daily Bulletin reported.

The convention also adopted a resolution urging Putrajaya to comply with the court’s decision and to reach an agreement within 180 days regarding the payment of the revenue share.

“As a Sabah representative in the federal government, we urge Ewon to consider resigning from the Cabinet should the AGC proceed with an appeal,” said Donald, who is Penampang Upko chief.

“Upko will stand in solidarity with the people of Sabah and remain committed to defending their rights as enshrined in the Malaysia Agreement 1963 (MA63) and the Federal Constitution, which are core principles of the party’s struggle.”

The Kota Kinabalu High Court ruled on Friday that the federal government acted unlawfully by failing to honour Sabah’s 40% share of net federal revenue from the state for nearly five decades.

The AGC yesterday said it would review the High Court’s written judgment before taking any further action.

In a statement, the AGC noted that one of the key issues in the dispute was the legal interpretation of Articles 112C and 112D of the Federal Constitution.

Article 112C of the Federal Constitution deals with special grants and the assignment of revenue to Sabah and Sarawak, while Article 112D provides for periodic reviews of these grants.
