RMAF denies delaying Court of Appeal order to reconvene court martial

KUALA LUMPUR:
The Royal Malaysian Air Force has denied an allegation by a former sergeant that the force had deliberately delayed the implementation of a Court of Appeal order to reconvene a court martial to rehear his drug-related case.

RMAF chief Norazlan Aris said the force viewed the implementation of the order seriously, but its process was subject to service procedures and legal provisions currently in force.

He said the RMAF had taken steps to implement the Court of Appeal’s order, and this matter would be further explained in the court proceedings.

“The RMAF is committed to ensuring that all actions taken are in line with the requirements of the law and public service procedures,” he said in a statement today.

Norazlan said the RMAF took note of the notice of application for committal submitted by Messrs Zalil Mohd & Partners, which had been submitted to the Attorney-General’s Chambers for further action.

The media on Friday reported that Ahmad Zaini Zainon, 42, who was convicted by the military court of drug offences, had filed an application for leave to commence committal proceedings against the RMAF chief for allegedly being in contempt of court.

Zaini filed the application through a notice of motion ex parte (one party) through the law firm of Messrs Zalil Mohd & Partners on Sept 25, seeking a committal order against the RMAF chief for failing to comply with the Court of Appeal’s order to hold a retrial of his case.
