Trio gets 30 years’ jail each for trafficking in 32kg of drugs

The Kuala Lumpur High Court today sentenced three men to 30 years’ imprisonment and 12 strokes of the cane each after finding them guilty of trafficking in 32kg of drugs six years ago.

Bernama reported that Justice Azhar Abdul Hamid handed down the sentence after finding that the defence had failed to raise reasonable doubt in the case against tow truck drivers S Uvaraja, 48, and R Kalaikumar, 40, and lorry driver K Paarthiban, 38.

“The court orders the three accused to be jailed from their date of arrest on June 18, 2019,” said Azhar.

The three men were charged with jointly trafficking in 32,682.4gm of methamphetamine in the car park of a condominium on Jalan Desa Pandan at 5.35pm on June 18, 2019.

The charge is under Section 39B(1)(a) of the Dangerous Drugs Act 1952 for drug trafficking, punishable under Section 39B (2) of the same act and read together with Section 34 of the Penal Code, which provides for the death penalty or 30 years’ imprisonment and no less than 12 strokes of the rotan.

Azhar also sentenced Uvaraja to another two years in prison after finding him guilty on two counts of possessing 0.15gm of MDMA and 0.003gm of heroin, as well as 0.007gm of 6-MAM at the same location and date.

The offence is under Section 12(2) of the Dangerous Drugs Act 1952 for drug possession, punishable under Section 12(3) of the same act, which provides for a maximum fine of RM100,000, or imprisonment not exceeding five years or both.

The prosecution was led by deputy public prosecutor Wan Ahmad Hijrah Wan Abdullah while the three accused were represented by lawyer Shafee Abdullah.
