Father to file police report against hospital over handling of baby’s remains

Lawyer also says action could be initiated against the private hospital for alleged wrongful retention of body.

The father of a deceased baby, who accused a private hospital of mishandling his child’s remains, will be filing a police report against the hospital.

Safwan Roshdy will be lodging the report soon, his lawyer, Ahmad Zaharil Muhaiyar, said, Berita Harian reported.

He said both civil and criminal action could be initiated against Hospital Bersalin Razif (HBR) for wrongful retention of the infant’s body for 16 days due to the father’s failure to settle the medical bill.

However, Zaharil said, the police and the health ministry should carry out further investigations.

Safwan, 22, had expressed his frustration over accusations allegedly hurled against him, including claims that he was not married, as well as insults and condemnation from netizens.

The factory worker said he would not hesitate to take legal action and has asked his lawyer to do what was necessary.

On Wednesday, HBR denied mishandling the baby’s remains and delaying the burial arrangements.

The hospital said the mother, who claimed it was her first pregnancy, arrived in active labour with no prior antenatal checkups.

It said she was accompanied by a man who was initially described as her husband, but who later clarified that they were not married.

HBR also revealed that the baby was born with cyclopia syndrome, with one eye, and several other physical defects.

The baby died shortly after receiving medical care, and the man was given a burial permit with instructions to arrange the burial the following day, it said.

It also said the mother, who was discharged the next day, informed hospital staff that she could not afford the RM2,840 hospital bill. Despite this, HBR said, it allowed the family to proceed with the burial while working out payment arrangements.

The media previously reported that the body was kept in the hospital mortuary, pending full settlement of a RM3,600 bill, despite repeated requests from the family to proceed with the burial.

The health ministry, through its private medical practice control division, has launched an investigation into the allegations.
