Court orders preacher to remove video on secret underage conversions

KUALA LUMPUR:
The High Court has issued an order to compel preacher Firdaus Wong to remove a video allegedly promoting secret underage conversions until the disposal of a suit brought by eight non-Muslim parents.

Justice Amarjeet Singh, who made the order after an inter-partes hearing, said Wong’s posting was in breach of Article 12(4) of the Federal Constitution.

“The content is as clear as daylight,” he said.

Article 12(4) states that the religion of a person under the age of 18 shall be decided by his parent or guardian.

Amarjeet also ordered Firdaus to pay the plaintiffs RM5,000 in costs and fixed April 29 to hear the originating summons.

Amarjeet issued an ex-parte order on Oct 16 in favour of the eight plaintiffs, valid for 14 days.

Firdaus’s lawyers later agreed to allow the order to remain in force until the disposal of the inter-partes hearing today.

However, lawyers representing the preacher also notified the court at the time that the TikTok video had already been taken down.

In today’s proceedings, lawyers Norazali Nordin and Syahidah Hanum Ghazali appeared for Firdaus while counsel M Visvanathan, V Pushan, and V Sanjay acted for the plaintiffs.

Firdaus had posted a video in June of him allegedly giving a man instructions on how to handle requests from minors wishing to secretly convert to Islam.

Numerous police reports were lodged against Firdaus after the video made its rounds on social media, leading police to probe the preacher under Section 505(c) of the Penal Code for making statements allegedly conducive to public mischief.

In the suit, the plaintiffs asked the court to declare that Firdaus had acted unlawfully in making such statements.

They also asked for an injunction to compel him to permanently take down the offending video and to restrain him from making similar statements in the future.

In his defence, Firdaus denied making the statements.
