Altantuya’s family demands update from AG on Sirul’s extradition

The family of the late Altantuya Shaariibuu has urged the attorney-general (AG) to give an update on its next steps in extraditing Sirul Azhar Umar, one of two former Special Action Unit (UTK) officers who were convicted for her murder.

This comes after Azilah Hadri, the other ex-UTK officer, had his death penalty commuted to a 40-year jail term by the Federal Court last Thursday.

Azilah, 48, was also ordered to be given the mandatory minimum 12 strokes of the rotan.

Sangeet Kaur Deo, the lawyer representing Altantuya’s family, said the AG has “no excuse” for any further delay.

“The AG is urged to act quickly and decisively in securing Sirul’s immediate return to face his sentence.

“Failing to pursue both cases with equal vigour reinforces the dangerous perception that the Malaysian legal system protects the powerful while failing the people it purports to serve,” she said in a statement.

In 2009, the Shah Alam High Court convicted both Azilah and Sirul of the crime.

The convictions were overturned by the Court of Appeal in 2013, but restored by the Federal Court two years later. Both accused were sentenced to death. However, Sirul fled to Australia before the final verdict was announced.

Sangeet also highlighted that the apex court had relied on an additional affidavit and statutory declaration in arriving at its decision to revise Azilah’s sentence, adding that these documents were not rebutted by the public prosecutor.

She said that the additional affidavit includes uncontested claims that Azilah acted under explicit instructions, a fact left unchallenged by the public prosecutor, “raising serious questions about the AG’s actions”.

“Altantuya’s family demands to know if these allegations have been investigated and if not, why do they remain unaddressed,” she added.

Sangeet said the civil suit has also led to serious findings of liability in relation to Abdul Razak Baginda and the government.

In the context of criminal investigations, the AG, as the guardian of the rule of law, has a duty to pursue every lead impartially and hold all individuals accountable, regardless of status, influence or affiliation, she added.

“Any hesitation or selective application of the law (or perception thereof) will rightly erode public trust and confidence in the office of the AG.”
