Wan Ahmad Nizam Wan Abdul Hamid was accused of attacking a 51-year-old woman by kissing her and touching her breasts at a house in Persiaran Bukit Melawati here between July 20 and Aug 15, 2020.

He was charged under Section 354 of the Penal Code for assault or use of criminal force with intent to outrage modesty.

Magistrate Amalina Basirah Top ruled that the prosecution had failed to prove its case against Nizam, who was Air Putih assemblyman from 2013 to 2018.

Deputy public prosecutor Zahida Zakaria appeared for the prosecution, while lawyers Haijan Omar, Nik Zarith Nik Moustpha and Aina Syazwani Mansor represented Nizam.

It was previously reported that police were investigating an “influential” politician from the east coast after a woman filed a report on March 16, 2021, claiming she had been molested by the suspect around July or August the year before.

At the time, Nizam denied the accusation, saying it was a “fake report”.
