
The Strata Management Tribunal made the order on Monday after a hearing between the representatives of the owners, the committee, and the city council’s commissioner of buildings, Norfarahdilah Ngaddemin.
In the order sighted by FMT, tribunal president Chia Kim Meang said the committee must send out the notice for an AGM in accordance with the Strata Management Act (SMA) 2013.
According to a representative of the 160 owners, the tribunal however turned down their request for the commissioner to conduct the meeting, arguing that the committee is currently an illegally constituted body by virtue of failing to adhere to the SMA.
“We raised our concern that the committee is deemed illegal for not holding the AGM and thus should not be allowed to conduct the meeting. We wanted the commissioner to do it.
“However, the tribunal president said that she has no power to direct the commissioner to carry out the AGM,” he told FMT.
He said the commissioner’s representative however agreed to attend the AGM as an observer to ensure that everything is run according to the law.
“We hope the committee will follow the order and the laws strictly to resolve the problems once and for all,” he added.
FMT has reached out to committee chairman Roger Chua for comment.
On Sunday, FMT reported that the owners of the luxury condominium units had criticised the committee and commissioner for leaving them in limbo since 2019.
The committee had also refused to hold an emergency general meeting despite the residents meeting the quorum requirement under the SMA.
The owners also accused the commissioner of failing to act on their complaints over the management committee’s disregard for the SMA.
