High Court upholds school principal’s acquittal in sexual assault case

BUTTERWORTH:
The High Court here has upheld a lower court’s acquittal of a school principal charged with sexually assaulting an 11-year-old pupil in 2018.

Zainuren Mohamed, 58, was charged with committing the offence on four pupils – two 13-year-old boys and two others aged 11 and 14.

The incidents were alleged to have taken place between April 6 and Oct 10, 2018 on the school’s premises.

In 2021, the prosecution dropped three of the four charges.

Last year, the sessions court freed Zainuren of the remaining charge after noting inconsistencies in the statements made by his alleged 11-year-old victim.

In the High Court today, Justice Fathiyah Idris agreed with the lower court’s decision to free Zainuren, noting that the trial judge had thoroughly evaluated the testimony of all witnesses provided and had correctly identified contradictions in the victim’s version of events.

In particular, the judge found that the victim had initially claimed he was subjected to a series of sexual assaults but later testified that they had never occurred.

Deputy public prosecutor Shahrezal Shukri prosecuted, while E Gnanasegaran, Audrey Wee and Vikneshwaran Sehgar appeared for Zainuren.
