SM Faisal, ex-wife trying to resolve matrimonial dispute, court told

The businessman's criminal trial for voluntarily causing hurt to Emilia Hanifi is postponed to allow parties to explore global settlement.

Businessman SM Faisal SM Nasimuddin’s criminal charge for voluntarily causing hurt to former wife Emilia Hanafi was adjourned today after the magistrates’ court here was told the duo were exploring a global settlement of their matrimonial dispute out of court.

Magistrate Nadia Othman fixed the case for mention on March 30 for the court to be appraised of the status of negotiations, according to Bernama.

Earlier, Emilia’s lawyer, Nazri Yahya, requested that the hearing be vacated as the parties were serious in their attempt to arrive at an amicable resolution.

“We will inform the court of the status of negotiations (by) March 30,” said Nazri.

SM Faisal’s counsel, Akberdin Abdul Kader, confirmed the negotiations, saying he had no objections to the request for postponement.

“If there is no solution, (we) will continue the trial on March 30,” he said.

Deputy public prosecutor Nur Aishah Ahmad Zakiuddin appeared for the prosecution.

Akberdin later told reporters the parties intended to negotiate a global settlement of the dispute, including ownership of conjugal property and mutaah claims presently before the shariah courts.

“This case has gone on for too long, we want to end it,” he said.

SM Faisal, 43, was charged under Section 323 of the Penal Code with intentionally causing injury to Emilia, 43, at a house in Desa Sri Hartamas here between 12.30pm and 4.30pm on Nov 22, 2015.

If convicted, he faces a maximum prison sentence of two years or a fine of up to RM2,000, or both.
