A five-member bench chaired by Chief Judge of Sabah and Sarawak Abdul Rahman Sebli had heard submissions from both Najib’s defence team and the prosecution over six days between Jan 19 and Feb 28.
Also on the panel are Justices Vernon Ong, Rhodzariah Bujang, Nordin Hassan and Abu Bakar Jais.
On July 28, 2020, Najib was convicted by Justice Nazlan Ghazali, then a High Court judge, for abuse of power, money laundering and criminal breach of trust (CBT) over SRC funds amounting to RM42 million.
His appeal to the Court of Appeal was dismissed on Dec 8, 2021.
Najib began his 12-year prison term on Aug 23, 2022 immediately following the Federal Court’s dismissal of his final appeal.
The former Pekan MP filed a motion to review the ruling in September last year on grounds that the court had breached the principles of natural justice, including his right to fair trial and to counsel.
Should the review be allowed, the Federal Court ruling on Aug 23 will be set aside and a new bench will rehear the appeal.
Najib’s final recourse is to obtain a royal pardon from the Yang di-Pertuan Agong if the review is dismissed. He has already filed a petition for clemency.
