This follows the dismissal by a three-member Court of Appeal bench of the prosecution’s appeal for the sentences imposed on them to be enhanced.
Bench chairman Justice Hanipah Farikullah said the High Court judge had duly considered all mitigating factors and public interest when imposing the minimum five-year custodial sentence on each of the accused.
“The judge had used his discretion after taking into account the sentencing trend for the offence,” said Hanipah, who sat with Justices Ahmad Nasfy Yasin and Supang Lian.
The other respondents, aged between 27 and 46, were Japri Abu Samah, Astro Jakaria, Nuriasbat Maamon, Edi Narsuna Nizar, Faris Yusoff, Fakhrurazi Ali, Sharfiq Ali, Noor Helmie Zanal Abidin, W Ihsan W Razali @ W Husin, Rustam Tanni, Azukismi Che Abdullah, Nik Arzahar Nik Mat and Masyre Narizan.
Faizal won the gold medal for Muay Thai (Thai boxing) in the 2013 SEA Games held in Myanmar.
Masyre and Nik Arzahar were firemen, and Azukismi is a former policeman.
The facts of the case revealed that Masyre was the gang leader.
The 14 had all pleaded guilty to the offence in March last year before Justice Azmi Abdullah, who ordered their sentences to begin from the date of their arrest, which was between 2020 and February last year.
They were charged under section 130V(1) of the Penal Code for being members of an organised criminal group at Red Warrior Muay Club in Jalan Sentul, Pandamaran, Klang, between May 2017 and Jan 22, 2020.
The offences carried sentences ranging from a minimum of five years in jail to a maximum of 20.
The investigation and prosecution were carried out under the Security Offences (Special Measures) Act (Sosma), a procedural law to combat offences against the state to maintain public order and security.
They had been in prison since their arrest as bail was denied to them.
Deputy public prosecutors Aznee Salmie Ahmad and Khairul Aisamuddin Abdul Rahman represented the prosecution.
Astro Jakaria and Edi Narusuna Nizar were unrepresented, while counsel Hakimi Abdul Kadir, S Sathya, Lee Win Xu, A Komathi, Izzat Irfan Taib, Zaleha Hayat, Lailawati Husain and Fazilawati Hussain appeared for the rest.
