
Indira’s lawyer, L Pavitra, said they will be appealing the decision.
“It was just a one-liner decision,” Pavitra said at a press conference after the proceedings.
Indira voiced her frustration with today’s court decision, saying the case had been going on for 13 years “with no solution in sight”.
“As a mother, I’ve been waiting for so long (to see Prasana Diksa) but, no matter what, I will see her again,” she said.
Indira Gandhi Action Team (Ingat) chairman Arun Dorasamy said they had “exhausted all avenues” and would be going to Parliament to seek the help of MPs.
While a special task force had been reported to have been set up by a former IGP, he said, they were unsure if it still existed.
“None of the law enforcement officers can tell us for certain if she’s alive. Former IGP Hamid Bador said he knows where she is. (If that is the case), why not repatriate her to be with Indira Gandhi?”
Prasana was taken by her father, Muhammad Riduan Abdullah, formerly known as K Pathmanathan, in 2009 and unilaterally converted to Islam.
Indira filed contempt proceedings claiming the police had failed to comply with a mandamus order issued on May 30, 2014 to recover Prasana and to file an affidavit every month together with copies of the investigation reports.
She has also filed a separate RM100 million civil suit against the IGP, the police and the government in the Kuala Lumpur High Court over the authorities’ inaction on the matter.
On Jan 29, 2018, a five-member Federal Court allowed a declaration sought by her that no single parent from a civil marriage could convert their minor children though the spouse had embraced Islam.
Following this ruling, the certificates of conversion issued by the Perak registrar of muallafs to her three children – Tevi Darshiny, Karan Dinesh and Prasana – became null and void.
Indira and Riduan (then Pathmanathan) had entered into a civil marriage on April 10, 1993, but he converted to Islam on March 11, 2009.
The whereabouts of Riduan and Prasana are unknown.
