
The suit, filed by Bersih, its president, and six other organisations, contends that the ordinance was unconstitutional.
New Sin Yew, representing all the eight plaintiffs, said the case will be heard by judge Ahmad Kamal Md Shahid on Oct 3.
The suit was brought by Bersih president Thomas Fann, Bersih, academic action front Gerak; Aliran; Suara Inisiatif Sdn Bhd; Kuala Lumpur & Selangor Chinese Assembly Hall; Save Rivers Sdn Bhd, and CIJ Communications Services Sdn Bhd.
Muhyiddin was prime minister at the time the Emergency (Essential Powers) Ordinance was promulgated in January 2021.
The plaintiffs seek a declaration that the ordinance was unlawful and unconstitutional, and thus null and void.
They also asked the court to determine whether several constitutional questions, including the Proclamation of Emergency of January 2021, and the Emergency Ordinance, should be tabled in Parliament, when a meeting of both houses had been adjourned.
