High Court makes second visit to site where Nhaveen was allegedly assaulted

Judicial commissioner and officials retrace the movements of a key witness to the alleged assault of teenager T Nhaveen in 2017.

A field known to locals in the leafy Bukit Gelugor neighbourhood as “Padang Openg” was inspected by the High Court today to verify the truth of a witness’ testimony in the T Nhaveen murder trial.

T Previin, 23, a key witness, had earlier testified that he saw Nhaveen, 18, being beaten up by four youths, who are accused of his murder, and another man.

The court convened at the Jalan Bunga Raya neighbourhood park to hear sworn testimony from Previin who showed court officials how he had walked from his home to the park 200m away, and from where he had seen Nhaveen being assaulted by the assailants.

This was the court’s second visit to the area.

Previin led the entourage to a mini plaza separating a playground and a football field where he said he saw Nhaveen being beaten. He described the area as brightly lit.

He also pointed out where he had first stood, by the side of the football field in that park, and saw the beating from afar.

Defence counsel Yagoo Subramaniam then sought permission from judicial commissioner Mohd Radzi Abdul Hamid to cross-examine Previin.

He suggested to Previin that the fight did not occur at the lower part of the plaza, as pointed out, but in front of a mini-market on the other end of the plaza facing Bingham Avenue.

Previin said it could have been there.

Later, when questioned by prosecutors, he said he had come with police officers to show the site at 5am on the day of the incident.

With the aid of plainclothes police officers, he demonstrated how the four accused and another man had allegedly bashed Nhaveen with helmets.

Later, the court entourage visited Previin’s house and some other places as he re-traced his movements on that day.

Previin’s testimony continues tomorrow.

J Ragesuthan, 18, S Gokulan, 18 and two others have been charged with the murder of Nhaveen on June 19, 2017. The other two were juveniles when they were charged.

They are accused of murdering Nhaveen near the Karpal Singh Learning Centre, Jalan Kaki Bukit, Bukit Gelugor, between 11pm and midnight.

Deputy public prosecutors Mohd Amril Johari, Noor Azura Zulkiflee and Yazid Mustaqim Roslan prosecuted.

Sukhindarpal Singh held a watching brief for the Bar Council, and Shakirah Sharifuddin appeared for the Human Rights Commission (Suhakam). Arun Ganesh Boopalan held a watching brief for Nhaveen’s family.
