According to a Berita Harian report, the investigation is being carried out under Section 504 of the Penal Code for intentional insult with intent to provoke a breach of peace.

It carries a penalty of up to two years’ imprisonment.

Acryl Sani, who will take over as the IGP on Tuesday, said the newscaster had slandered the police and incited the public against the force when reporting on the RM50,000 fine imposed on a burger seller in Kelantan.

That incident led to criticisms from social media users, NGOs, and politicians who urged the authorities to exercise discretion in enforcing the law.

“The police action is based on provisions of the law to curb the spread of Covid-19,” he said, adding that investigations are also being carried out under Section 233 of the Communications and Multimedia Act 1998 for improper use of network facilities.

Acryl Sani said he hoped that “certain parties” in the country would not slander the police and incite hatred towards the authorities.

“We hope the public will not spread baseless statements on social media to the point that it can affect the harmony between the people and enforcement agencies.

“I urge those who are not satisfied with any action taken by the enforcement agencies to put forward their grouses using the right channels.”
