MIA council says ‘not involved’ in action against ex-1MDB auditor

The Malaysian Institute of Accountants council asks court to be removed from an action by KPMG auditor Ahmad Nasri Abdul Wahab to challenge a disciplinary board's findings.

The council of the Malaysian Institute of Accountants has applied to be removed from a judicial review filed by a former 1MDB auditor from accounting firm KPMG.

The MIA council, in documents filed in court, said they were improperly and unnecessarily made a party to the action by KPMG auditor Ahmad Nasri Abdul Wahab to challenge the MIA disciplinary board’s findings against him over his role with regard to 1MDB.

Nasri had named the council together with the MIA disciplinary appeal board in his judicial review challenge.

In its application, the council said that Nasri’s application does not involve them, as the judicial review was merely to quash the disciplinary appeal board’s ruling that found him guilty of failing to furnish documents to the tribunal.

“The council was not involved in the disciplinary proceedings taken against him,” the council said.

It was reported Nasri allegedly refused to provide confidential information on 1MDB to the MIA investigation committee. In his defence, he said he was prohibited by banking laws from providing the information.

In August, Nasri was granted leave by the Kuala Lumpur High Court to quash the disciplinary board’s decision.

He was also allowed to stay the disciplinary board’s findings from being published to the public pending the case being heard in court.

The High Court fixed Oct 28 for mention for Nasri’s striking out application.

In 2016, Damansara MP Tony Pua said that he lodged complaints against Nasri and Deloitte auditor Ng Yee Hong alleging that both audit firms “intentionally and/or negligently failed to conduct sufficient and necessary due diligence and audit of 1MDB which had resulted in the filing of fraudulent 1MDB annual financial statements”.

During Najib Razak’s 1MDB trial, former company CEO Mohd Hazem Abdul Rahman told the court that 1MDB had been under “pressure” to change KPMG to Deloitte as the external auditor after KPMG partner Johan Idris refused to close 1MDB’s 2013 financial year report.
