
This is based on a draft consent order filed at the High Court Registry here on Sept 30.
Lawyer S Saravana Kumar, representing Tengku Adnan, better known as Ku Nan, had told reporters on Sept 23 the suit was amicably settled for LHDN to recover RM57.2 million in tax arrears from his client.
This means the RM40.3 million stated in the order is nearly RM17 million less than the sum originally sought by LHDN.
The order states that Tengku Adnan and LHDN agree for amendment to the additional assessment notices for the assessment years 2012 to 2017 to come up to a figure of RM40,358,336.61.
It states that the RM40.3 million in assessments, including penalties, forms the settlement on the tax sought by LHDN.
“Both parties will within 45 days of the date of the order discuss the mode of payment,” the order says.
“The RM40.3 million must be paid before Dec 31 even if the parties fail to reach agreement on the mode of payment.”
The order says Tengku Adnan and LHDN have also agreed to withdraw all interlocutory applications in relation to the suit with no order to cost.

Last year, LHDN filed the lawsuit against Tengku Adnan, who is also the Putrajaya MP, to recover RM57.2 million in tax arrears from 2012 to 2017.
