Consumer Association of Kedah (CAKE) secretary Mohamad Yusrizal Yusoff said the politician was negligent as he failed to get himself tested for the virus after returning from campaigning in Sabah, which was a high-risk area.
The health ministry said the new “Bah Lunas” cluster had been detected in Kulim, turning it into a yellow zone with three cases as of noon yesterday. There are 809 cases in Kedah, with 475 patients under treatment and six dead so far.
“We will not compromise with anyone who went against the Covid-19 SOPs or being wilfully negligent, causing the consumers and the people in Kedah to suffer,” Yusrizal told FMT.
“The lawsuit would be initiated by the people of Kulim against the said politician for free. Those who want to be part of the lawsuit may contact us on Facebook or 04-7718241.”
Businesses affected by the new cluster, and parents of SK Permatang Janggus students in Butterworth would also be a part of the suit, he said.
The students’ parents are also involved as the politician’s wife, a teacher in the school, also tested positive.
This led to 396 students being tested last week, with 71 found negative as of yesterday. The other results have yet to be revealed.
The vicinity of the school is currently off-limits to the public for a week from Oct 1.
FMT has contacted the politician concerned for comment.
On Aug 19, CAKE filed a RM1.5 million civil suit against an Indian national said to be the originator of the Sivagangga Covid-19 cluster at the High Court here.
It sought an interim injunction to prevent nasi kandar restaurant operator Nezar Mohamed Shabur Batcha from leaving the mukim or subdistrict of Napoh in Kubang Pasu, Kedah, or leaving the country until disposal of the case.
CAKE’s lawyer, Mohammad Zunun Baihakky, said the claimants were business owners, workers and wage earners affected by the targeted enhanced movement control order imposed due to Nezar’s violation of a 14-day quarantine upon his return from India.
Other claimants include Jawatankuasa Peniaga RTC Pekan Napoh, Kelab Usahawan Belia Napoh, Persatuan Peniaga Kecil dan Penjaja Napoh and two residents’ associations in Napoh.
Yusrizal said the proceedings had been stalled because of the lockdown in Alor Setar.
