You cannot contest again, Sivarraajh told

A lawyer says election laws prohibit the MIC man, whose victory in Cameron Highlands was nullified from contesting in the by-election.

A DAP lawyer has warned MIC’s C Sivarraajh that he could be disqualified as a candidate in his bid to reclaim the Cameron Highlands federal seat next month.

RSN Rayer, who is also the Jelutong MP, said as Sivarrajh’s victory was annulled for violating the Election Offences Act 1954, he could be also be disqualified from contesting in the by-election on Jan 26.

“In these circumstances, Sivarraajh would be ‘incapacitated’ (legal disqualification) from contesting in the upcoming by-election under the act,” he said in a statement.

Rayer said according to the law, anyone found guilty of committing an election offence would have his victory disqualified.

Citing Section 37 of the Act, he said the person whose victory was annulled could not contest again.

Cameron Highlands has traditionally been an MIC seat. Sivarraajh had won the constituency with a 597-vote majority, beating four others including his closest rival from DAP.

The Election Court ruled on Nov 30 that there had been vote-buying on the Barisan Nasional side during the general election campaign.

Orang Asli leaders had also testified that BN gave a total of RM2,100 to six of their leaders a few days before polling day, including RM200 as “duit rokok” (pocket money).
