Anwar: AGC should explain in detail why it dropped Lim’s case

PKR president says this is in view of Guan Eng's seniority in Cabinet.

Anwar Ibrahim said the Attorney-General’s Chambers (AGC) should explain in greater detail its decision to drop the graft case against Lim Guan Eng, due to the minister’s post in the Cabinet.

The PKR president said while the AGC felt the case may have been weak, the public perception may be different as Lim is the finance minister.

“So it is only proper for the AGC to provide a convincing explanation for its decision.

“I want to see for myself this explanation that led to the judge agreeing with the AGC,” the former deputy prime minister said in an interview with Astro Awani tonight.

Two days ago, the head of the Appellate and Trial Division at the AGC, deputy public prosecutor (DPP) Mohamad Hanafiah Zakaria, said the decision to drop the case against Lim and businesswoman Phang Li Koon was made in light of new evidence and knowing that the case would not succeed.

Lim was charged with using his public office to obtain gratification for himself and his wife by approving an application by Magnificent Emblem to convert agricultural land for residential purposes during a state executive council meeting on July 18, 2014.

He was also charged with using his position to obtain gratification by purchasing a bungalow from Phang at below its market value. Phang was charged with abetting him.

The decision to drop the charges against Lim and Phang has been criticised by various groups, including Umno.

Some said it reflected badly on the AGC and the Pakatan Harapan government. Others questioned the decision based on the fact that AG Tommy Thomas had previously represented Lim in the case, with a few even calling for his resignation.

But Anwar today said that while the AGC had the authority to drop the case, there was nothing wrong in asking for a detailed explanation.

“I feel his case is somewhat politically motivated as Lim Guan Eng’s house is smaller than that of most ministers.”
