Bersih wants tribunal established to investigate EC

The electoral watchdog plans to send a letter to Dr Mahathir Mohamad urging for the setting up of a tribunal to investigate the alleged misconduct of the Election Commission in GE14.

Electoral watchdog Bersih 2.0 plans to appeal to Prime Minister Dr Mahathir Mohamad to establish a tribunal to investigate the “misconduct” of the seven-member Election Commission (EC) in the 14th general election (GE14).

The seven are former chairman Hashim Abdullah, deputy chairman Othman Mahmood, commissioners Yusop Mansor, Abdul Aziz Khalidin, Sulaiman Narawi, K Bala Singam and Leo Chong Cheong.

Speaking at a press conference outside Parliament, Bersih 2.0 acting chairman Shahrul Aman Mohd Saari said it was crucial that the tribunal be formed as soon as possible to ensure future elections would be clean and fair.

“The six who are still in office now need to be held accountable for what they did prior to, and during, GE14.

“Their misconduct violated the basic rights of the citizen to choose a new government and threatened the very foundation of our democracy.

“The commissioners, if they have lost public confidence, should no longer hold office,” he said.

The appeal letter would be submitted to the PM as soon as possible, he added.

Among others, one major “misconduct” detected by Bersih 2.0 and ENGAGE, another NGO, is that 3,525 retired police officers were still classified as advance voters, including two former inspectors-general of police.

“This was despite the regulation stating that only serving members qualify as advance voters.

“Apart from that, there were also issues of ballot secrecy and safe custody of ballots for advance voting by police officers and military personnel who voted five days in advance of normal voters,” said Shahrul.

Another violation was over GE14 observers, where the observers from overseas had only arrived two days before polling day, he said.

“The EC did not provide any further update or information with regards to the scope, terms of reference, and status of the observers.

“Accredited domestic observer Majlis Belia Malaysia (MBM) was seen conducting nationwide campaigns for Barisan Nasional,” he alleged.

Shahrul pointed out that five EC commissioners appointed between 2013 and 2018, including the chairman and deputy chairman, were previously civil servants.

“Worst, Hashim was personal aide to Umno information chief Annuar Musa from 1990 to 1999, while Othman was senior deputy chief secretary in the Prime Minister’s Department during the former prime minister’s tenure in office (2011 to 2017).

“While Hashim resigned on July 1, the six other commissioners still remain as part of the EC. They should all be removed from the commission,” he said.

Kota Melaka MP Khoo Poay Tiong, who was present at the press conference, said: “I am moving a motion in the Dewan Rakyat against the six EC members, calling for them to resign due to alleged irregularities which occurred during GE14.

“I hope this motion will be debated this sitting. My constituency was one of those which were affected.”

He added that the government should not take too long to review proposals to reform the EC.

“I asked last week what were the government’s long term and short term plans to reform these institutions. But I only got an answer saying that they were reviewing proposals to reform the EC and other institutions involved in manipulating the GE14,” he said.

He added that one of the most crucial cleanups that needed to be done was the clean up of the electoral roll.
