The inquiry was today informed that Saiful Afdzan, a restaurant operator in Perlis, will be charged under Section 174 of the Penal Code.
“We will be issuing him a court summons to attend the hearing (at Suhakam),” Sentul police chief R Munusamy told reporters.
Amri went missing on Nov 24, 2016.
His wife previously said that five vehicles had blocked his car before he was whisked away, some 500m from their home in Bukit Chabang, Perlis.
Saiful is the owner of Restaurant Mak Lang, a stone’s throw from the scene of the abduction.
Munusamy later confirmed to reporters at the Suhakam headquarters here that Saiful would be served with a courts summons.
“It’s not an arrestable offence, so we will apply for a summons.
“He will be charged. Once we serve it on him, he will have to show up in court,” he said.
Saiful is one of the several eye-witnesses who say they witnessed Amri’s abduction.
He was previously summoned to appear before the inquiry, but said he was unable to do so as he would have to close his shop in order to travel to Kuala Lumpur.
However, he showed up unannounced at Suhakam’s inquiries on several occasions when he appeared upset that he was unable to speak as time had been allocated for other witnesses and persons of interest to testify instead.
