This followed a decision by a panel of five judges, chaired by Appeals Court president Zulkefli Ahmad Makinudin, in dismissing the appeal by Mohamed Danny, 31, for the sentence to be reduced.

In the judgment, Zulkefli, sitting with Chief Judge of Malaya Ahmad Maarop and Federal Court judges Ramly Ali, Zaharah Ibrahim and Aziah Ali, said after considering the facts of the case, the court could not simply change the jail sentence, unless it was erroneous in facts and law.

He said the punishment revised by the Court of Appeal was apt and appropriate.

“We dismiss your appeal. The eight-year jail sentence is upheld. Based on prison rules, if you behave well, the sentence can be reduced,” Zulkefli told Danny.

Danny was appealing against the Court of Appeal’s decision, made on Feb 6, 2017, in doubling his prison sentence to eight years, after allowing the prosecution’s appeal against the four-year jail term meted out by the High Court.

The Kuala Lumpur High Court had sentenced Danny to four years’ jail after he pleaded guilty to a charge of knowingly dealing with the property belonging to Wanndy by allowing the deposit of RM12,130 into his bank account and also the withdrawal of RM10,000 for the benefit of the terrorist.

Danny, from Melaka, was charged with committing the offence at the Maybank Ayer Keroh branch in Malacca between Jan 28 and March 5 last year.

The charge, under Section 130Q(1) of the Penal Code, provides an imprisonment of up to 20 years, or fine, and forfeiture of the property concerned.
