
At the proceeding at the Magistrate’s Court here today, Magistrate Roslizi Sulaiman granted deputy public prosecutor (DPP) Amira Abd Aziz’s application to amend the charge against Teoh Thiam Lim, 28, after being notified that one of the victims, Evelyn Ang Gek Suan, died on March 1.
The court’s interpreter then read out the amendment to Teoh, that he was charged with driving a Proton Iswara car recklessly or in a dangerous manner, resulting in the death of Ang, 44, at Batu 2, Jalan Kapar here, at 4.30am on Dec 10 last year.
He was charged under Section 41 (1) of the Road Transport Act 1987 which carries a maximum jail term of 10 years and a fine not exceeding RM20,000, as well as suspension of the driving licence, upon conviction.
However, Teoh claimed trial to the amended charge.
Teoh was previously charged with driving a Proton Iswara car in a reckless manner that could endanger others at Batu 2, Jalan Kapar, here, about 4.30am on Dec 10 last year.
The charge was made under Section 42(1) of the Road Transport Act 1987, that provides imprisonment for up to five years and a fine of up to RM15,000 upon conviction.
Roslizi retained the RM5,500 bail which he previously granted Teoh and fixed March 30 for mention, pending the post-mortem report and submission of documents.
The media previously reported that runner Ang, died of severe head injuries at 1.13am at the Sungai Buloh Hospital, almost three months after she was hit by a car while participating in a marathon.
In the incident, two other runners, Amiruddin Hamid, 37, and Ahmad Hadafi Jus, 42, were also injured after being hit by a car from behind when a marathon around the town was underway.
