Jamil Khir succeeds in dismissing suit by foundation

The Pemangkin foundation had filed the suit claiming misconduct by the minister.

KUALA LUMPUR: Minister in the Prime Minister’s Department Jamil Khir Baharom today succeeded in his application to strike out a suit filed by Yayasan Pembangunan Anak Yatim/Miskin (Pemangkin) for alleged misconduct and attempts to shut down the foundation.

Lawyer Adnan Seman, representing Jamil Khir, told the media that High Court Judicial Commissioner Faizah Jamaludin struck out the suit in chambers in the presence of lawyer Suhaimi Kamaruddin, who represented the three plaintiffs named in the suit.

The plaintiffs are the foundation founders, Mohd Yusoff A.Bakar, 65, Ahmad Fazil Hashim, 61, and Pemangkin.

Adnan said the court struck out the suit on grounds that the writ of summons and the statement of claims did not state a reasonable cause of action, it was an embarrassment, petty and an abuse of the court process.

The court also ordered the plaintiffs to pay cost of RM2,000 to Jamil Khir, who was named the first defendant in the suit, he said.

Others named as defendants in the suit were members of the Pemangkin Board of Trustees, comprising Shahlan Ismail, 59; Mohd Yusof Abd Rahman, 62; Mokhtar Abdul Razak, 59; director-general-cum-chief executive officer of the Malaysian Islamic Economic Development Foundation (Yapeim) Abibullah Samsudin, 58; Yapiem legal director Sharina Ramli, former company secretary Normala Embi, 54, and Yapeim.

The same court had struck out the suit against the seven defendants on Nov 10 last year.

In the statement of claim, the plaintiffs had sought a declaration that Pemangkin was an entity on its own and not a subsidiary of any company or foundation or establishment, including Yapeim.

They had also sought a declaration that instructions and action by Jamil Khir and the seven other defendants to make Pemangkin a dormant company was illegal, and also a declaration that the appointment of Abibullah as Yapeim chief executive officer was null and void.
