PETALING JAYA: A credit control officer was fined the maximum RM2,000 in default two months’ jail under Section 323 of the Penal Code for slapping a Nepalese security guard at an apartment near here on Sunday.

Magistrate Nur Shahirah Abdul Salim sentenced Mohammed Hafiz Mohamed Fadzil, 31, after he pleaded guilty to voluntarily causing hurt to Sambar Lama by slapping him on his left cheek.

The incident happened at Mentari Court Apartment in PJS8/9, Sungei Way Street, here at 9.20pm, on Jan 21.

According to the facts of the case, the victim, who was on duty at the main entrance of the apartment, had directed the accused to register at the guardhouse before entering the apartment. Instead, Hafiz refused and slapped him.

Hafiz, who was unrepresented, mitigated for a minimum fine, telling the court that he had just started working and had a wife and three children to support.

However, deputy public prosecutor Abu Arsalnaa Zainal Abidin urged the court to impose an appropriate sentence as a lesson to the accused and on account of public security.
