
Referring to Apandi’s comment earlier today that he had “nothing to hide” over the investigations into allegations made against the state-owned investment firm, Gobind said he should then just come out with the proof on why he decided to clear Najib.
“I challenge Apandi to show us the money trail which supports his finding that the RM2.6 billion was indeed a donation. What is the difficulty in doing that?
“Apandi, of all people, should know that it is a most basic principle of natural justice that no person can judge a matter in which they themselves have an interest. (Nemo judex in causa sua),” said Gobind, who is DAP national legal bureau chairman.
The Puchong MP added that simple declarations such as that which Apandi had made today, have little effect, when the conduct of the AG itself comes into question.
“In order to convince people, he should produce a report in which he sets out in full the documents showing us the money trail which he used in arriving at his decision. That report must then be tabled in Parliament and made public.
“Apandi should be brave and take up my challenge. After all, as he says, he has done no wrong and there is nothing to hide,” Gobind said.
Apandi’s comments were in turn a response to accusations made against him by former prime minister Dr Mahathir Mohamad at a ceramah in Shah Alam last night.
At his maiden speech as Pakatan Harapan chairman, Mahathir, at a “Love Malaysia, End Kleptocracy” campaign ceramah, claimed there were reports linking Najib to the alleged embezzlement of funds from 1MDB, following investigations by the Malaysian Anti-Corruption Commission (MACC), Bank Negara and the auditor-general.
But these reports, he alleged, were sealed under the Official Secrets Act (OSA), making it inaccessible to those without clearance.
“OSA doesn’t mean a criminal act can become an official secret. Hiding evidence of a crime is an offence. We will ask the attorney-general about this,” Mahathir said, referring to Apandi.
