Tian Chua fined RM3,000 for insulting police officer

PKR MP will be disqualified from defending Batu parliamentary seat in GE14 unless conviction is quashed upon appeal or fine is reduced.

PKR’s Tian Chua was fined RM3,000 by the Sessions Court here today for insulting a police officer using vulgar words, three years ago.

Judge Yasmin Abdul Razak ruled that the defence had failed to raise a reasonable doubt to the prosecution’s case.

“If the accused fails to pay, he would need to serve a three-month jail sentence,” she said.

Chua claimed trial on Aug 12, 2014 to a charge under Section 509 of the Penal Code for insulting the modesty of DSP Glenn A Sinappah.

He committed the offence at the main entrance of Armada Hotel at 7.45 pm on April 14, 2014.

The charge under Section 509 of the Penal Code carries a maximum jail term of five years, or fine, or both, upon conviction.

In an immediate response, Chua’s lawyer lawyer Latheefa Koya said they will be appealing the conviction and the sentence.

“He will be disqualified from being able to defend his parliamentary seat in the next general election (GE14) unless he is acquitted or has the fined reduced upon appeal,” she said.

She added, however, that Chua will remain as Batu MP pending his appeal.
