The suit is over the 1MDB scandal.
Pua’s lawyer Aliff Benjamin Suhaimi was speaking with the media after meeting Judicial Commissioner Roslan A. Bakar in chambers.
“The hearing for the striking out has been set,” he confirmed.
On Monday, the appeals court allowed the MP to reinstate two paragraphs and exhibits in his affidavit. These relate to striking out the Prime Minister’s defamation suit.
Aliff added that Najib’s lawyer, Nik Alia Hanafi, did not indicate in chambers on Thursday if they would challenge the Court of Appeal’s decision.
Najib sued Pua and MediaRakyat owner Chan Chee Keong, last year, over a statement the lawmaker purportedly made at a fundraising dinner function.
He claims that Pua had made a defamatory remark defaming him over 1MDB.
The statement, he claimed, was uploaded by Chan himself and/or his agents on YouTube and the Mediarakyat website under an allegedly libellous heading.
Najib further alleged that Pua’s speech meant that he had robbed the people of their money through IMDB transactions, cannot be trusted and was not qualified to hold public office.
Najib is seeking damages.
